Terms & Conditions – LibraryChef

Effective Date: January 1, 2024

Welcome to LibraryChef! By using our platform, you agree to these Terms & Conditions (“Terms”). Please read them carefully.

1. Eligibility and Account Registration

  • Users must be at least 18 years old.

  • Accounts can be for individual users (realtors) or institutional users (public libraries).

  • You agree to provide accurate, complete, and up-to-date information when registering.

  • Accounts are non-transferable, unless explicitly authorized.

  • Institutional accounts must be managed by an authorized representative.

2. Subscription Plans and Payment Methods

  • LibraryChef offers Starter, Pro, and Elite plans, each with included credits and features.

  • Realtors:

    • Paid via secure online payment; annual subscriptions billed once per year.

    • Extra credits are a one-time payment.

  • Libraries:

    • Paid via cheque only, prior to account activation.

    • No online payments; all payments are non-refundable.

  • LibraryChef may update plan features, pricing, or included credits with prior notice.

3. Upgrades and Downgrades

  • Upgrades: Existing credits accumulate with new plan credits.

  • Downgrades:

    • Allowed from Elite → Pro or Starter, and Pro → Starter.

    • Remaining credits do not add to the new plan’s credits.

    • Total credits reset to the new plan’s included amount minus any used credits.

  • All upgrades/downgrades are manual via LibraryChef support.

  • No refunds or prorated credits are provided, except in exceptional cases at LibraryChef’s discretion.

4. Credit Usage

  • Credits are used to access digital content, live classes, on-demand sessions, or library patron benefits.

  • Credits may expire according to plan terms.

  • Extra credits are immediately added and independent of annual subscription.

  • Libraries must use credits internally and may not redistribute to third parties outside the institution.

5. Health & Wellness Disclaimer

  • LibraryChef provides cooking, nutrition, wellness, and lifestyle content, including live classes and on-demand sessions.

  • Content is for educational and informational purposes only.

  • Do not consider LibraryChef content as medical advice. Always consult a healthcare professional before starting new diets, exercise, or wellness routines.

  • LibraryChef is not responsible for any injuries, health issues, or damages arising from the use or application of our content.

  • Participants must exercise caution and follow safety guidelines when performing activities suggested in classes or videos.

  • Parents/guardians are responsible for minors participating in any content.

6. Payment and Billing

  • Realtors: processed online; annual renewal automatically charged unless canceled.

  • Libraries: payment by cheque only; LibraryChef is not responsible for lost, delayed, or misdirected cheques.

7. Refunds and Cancellations

  • No refunds for subscriptions, included credits, or extra credits.

  • Downgrades/cancellations do not result in monetary refunds.

  • Exceptional complaints may be considered at LibraryChef’s discretion, but no obligation exists to provide compensation.

8. Intellectual Property

  • All content, logos, and materials are owned by LibraryChef.

  • Users may access content according to the plan but may not reproduce, distribute, or modify it without permission.

  • Libraries may use content only for internal purposes for patrons.

9. User Conduct

By using LibraryChef, you agree not to:

  • Use content for illegal purposes

  • Share accounts with unauthorized users

  • Interfere with the platform’s operation

  • Misuse content outside plan’s intended scope

10. Limitation of Liability

  • LibraryChef provides content “as is”.

  • Maximum liability is limited to the amount paid by the user in the prior 12 months.

  • LibraryChef is not liable for indirect, incidental, or consequential damages, including any harm from using wellness or nutrition content.

11. Privacy

  • LibraryChef’s Privacy Policy governs data collection and use.

  • By using our services, you consent to our practices.

12. Termination

  • LibraryChef may terminate accounts for violating Terms.

  • Upon termination, access to credits and content is revoked.

13. Governing Law and Dispute Resolution

  • Terms governed by New Jersey, USA law.

  • Disputes resolved through binding arbitration where permitted.

14. Changes to Terms

  • LibraryChef may update Terms at any time.

  • Updated Terms posted with a new Effective Date.

  • Continued use constitutes acceptance of updated Terms.
